PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING THE PEMY APPLICATION.

This Agreement is a legally binding contract between you ("User") and the developers of Pemy ("we," "us," "our") governing your use of the Pemy mobile application, including all associated features, content, and services (collectively, the "Application").

BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE APPLICATION, YOU (A) ACKNOWLEDGE THAT YOU ARE 18 YEARS OF AGE OR OLDER; (B) REPRESENT THAT YOU HAVE THE CAPACITY TO BE BOUND BY THIS AGREEMENT; (C) ACCEPT AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS SET FORTH HEREIN; AND (D) AGREE TO THE PROCESSING OF YOUR DATA AS DESCRIBED IN OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE APPLICATION IN ANY MANNER.

2.1. License Grant

Subject to your strict and ongoing compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use the Application for your personal, non-commercial use on a mobile device that you own or control.

2.2. In-App Purchases

• The Application may offer in-app purchases ("IAP") for digital content or services.
• Payment and Billing: All payments for IAP are processed exclusively through the Apple App Store. You will be billed by Apple for any purchases made through your Apple ID account.
• Purchase Information: By confirming any purchase, you agree to pay the applicable price displayed to you for the item(s) you select. All sales are final, and we do not provide refunds for IAP, except as may be required by applicable law or the App Store's own policies.
• Subscription Terms (if applicable): If you purchase an auto-renewing subscription, your subscription will automatically renew at the end of each term until you cancel it. You can manage and cancel your subscriptions at any time through your device's App Store account settings.

2.3. User-Generated Content (UGC) & Acceptable Use Policy

The Application provides functionality for users to create, post, and share UGC. You are solely and entirely responsible for all UGC you post, and the consequences of sharing it.

2.3.1. Your Responsibilities and Warranties

You represent and warrant that:

• You own or possess the necessary licenses, rights, consents, and permissions to all UGC you submit.
• Your UGC does not and will not violate, misappropriate, or infringe upon the rights of any third party, including copyright, trademark, patent, trade secret, moral rights, privacy rights, rights of publicity, or any other intellectual property or proprietary rights.
• Your UGC complies with all applicable laws, rules, and regulations.

2.3.2. Strictly Prohibited Content – Zero Tolerance Policy

We maintain a ZERO TOLERANCE POLICY for objectionable content and abusive users. You EXPRESSLY AGREE that you will NOT create, upload, post, display, publish, distribute, or transmit any UGC that falls into the following categories:
